By using NodeMini services, you confirm that you have fully understood andunconditionally acceptedall provisions of these Terms. These Terms grant NodeMini the broadest rights necessary to operate, maintain, and protect the platform.

Legally Binding Agreement:By accessing this platform, registering an account, clicking "I Agree," or using any service provided by NodeMini in any manner, you are deemed to have fully read, thoroughly understood, and unconditionally accepted all provisions of these Terms of Service. These Terms carry the same legal effect as a written and signed contract. If you object to any provision, your sole recourse is to immediately cease using the service and close your account; continued use of the service constitutes ongoing acceptance of all Terms.

General Provisions and Definitions

These Terms of Service (hereinafter "the Terms" or "ToS") are formulated and published byNodeMini Globaland all of its existing and future affiliates (collectively "NodeMini" or "we"), and are binding upon all individual users, enterprise clients, and other organizational entities (collectively "users" or "you") who access or use NodeMini's cloud Mac computing rental services and all related services through any channel.

These Terms, together with the Privacy Policy, Acceptable Use Policy (AUP), and other supplemental agreements published, revised, or supplemented by NodeMini from time to time, constitute a complete legal document framework. In the event of a conflict,these Terms shall prevail, followed by the specific supplemental agreements. NodeMini retains final authority to interpret and revise all such documents at any time.

1.1 Key Definitions
Instance
The exclusive right of use for a single physical Apple Mac device provided by NodeMini to a user, including the processor, memory, storage, and network resources of that device. The configuration parameters of an instance are as actually displayed in the NodeMini console.NodeMini reserves the right to adjust specific specifications within an equivalent performance range without additional notice or compensation.
Rental Period
The period during which a user has the right to use an instance under the selected plan, commencing when the user purchases and activates the service.The rental period begins counting from the moment of activation, regardless of whether the user actually logs in or uses the instance.
Credentials
All connection information provided by NodeMini to the user upon instance activation, including SSH, VNC, and web console access methods.The secure keeping of credentials is solely and entirely the user's responsibility. NodeMini bears no joint liability for any credential breach.
User Content
All data, code, files, and applications uploaded, stored, executed, or transmitted to an instance by the user during the use of the service.The user bears full and exclusive legal responsibility for the legality, security, and compliance of all User Content.
Fees
All amounts that the user is required to pay to NodeMini under these Terms, including rental fees, add-on feature fees, and all applicable taxes.All taxes are borne solely and in full by the user. NodeMini bears no obligation to withhold or prepay any taxes on the user's behalf.
Platform
The collective term for all software, systems, APIs, management consoles, and related digital assets provided by NodeMini. NodeMini holds complete and unrestricted ownership and final interpretive authority over the Platform. The user's right to use the Platform is unilaterally granted by NodeMini and may be unilaterally revoked at any time.
1.2 Agreement Effective Date and Amendments

These Terms take effect from the date you first access the Platform.NodeMini reserves the right to unilaterally modify any provision of these Terms at any time without prior user consent.Revised Terms take effect immediately upon publication on the Platform or through official channels. Your continued use of the service after any revision constitutes unconditional acceptance of the revised Terms. NodeMini recommends that you review these Terms periodically, though failure to do so does not affect the binding force of the revised Terms on you.

Declaration:If you use the service on behalf of an organization, enterprise, or other legal entity, you represent and warrant that you have full legal authorization to accept these Terms on behalf of that entity, and that the entity is also bound by these Terms. NodeMini bears no obligation to verify whether you hold such authorization.

Account Registration and Security

2.1 Registration Eligibility and Review

You must be a legal adult (at least 18 years of age) with full civil capacity to register and use this service. When registering on behalf of a company, the registrant must hold appropriate legal authorization.NodeMini reserves the absolute right to refuse any registration application or terminate any account at any time without providing a reason, regardless of whether the user has completed payment.

2.2 Obligation of Information Accuracy

You must ensure that all information provided during registration and throughout your use of the service is truthful, accurate, and complete. All legal consequences and losses arising from providing false information, impersonating another person, or deceiving NodeMini in any way are borne solely by the user. If NodeMini terminates an account for this reason, all fees paid are non-refundable, and NodeMini reserves the right to pursue full indemnification from the user for all resulting losses, including indirect losses.

2.3 Account Security and Full Liability

You bear full, indivisible legal liability for all actions taken under your account — whether or not they were carried out by you personally.Regardless of whether an account has been subject to unauthorized access, NodeMini treats all actions taken in the name of your account as your own actions. You must:

  • Set a sufficiently strong login password and change it regularly; enable two-factor authentication (2FA) — NodeMini bears no liability for any losses incurred by accounts that have not enabled 2FA.
  • Safeguard SSH private keys and all credentials and never disclose them to any third party in any form.
  • Never transfer, sell, lend, or allow any third party to use your account for any purpose.
  • Immediately notify NodeMini in the event of credential breach or unauthorized access, though NodeMini bears no liability for losses that occurred prior to receiving such notification.
2.4 Account Quantity and Abuse

Each natural person or legal entity is limited to one primary account. NodeMini reserves the right to unilaterally identify, merge, or immediately terminate multiple accounts held by the same entity. Multi-account behavior (including but not limited to circumventing bans or exploiting promotions) will be deemed a material breach, resulting in the termination of all related accounts with no refund of fees paid. NodeMini also reserves the right to pursue indemnification from the user accordingly.

Service Description and Scope

NodeMini provides remote exclusive access to physical Apple Mac devices. Users have exclusive access rights to their assigned instance during the rental period. NodeMini retains ownership and ultimate administrative authority over all underlying physical infrastructure, network environments, and system-level configurations at all times. The user's use of the service does not affect these rights of NodeMini.

3.1 Scope of Service
  • Instance Access:SSH command-line, VNC graphical interface, and web console access are provided during the rental period (subject to actual availability; NodeMini does not guarantee simultaneous availability of all three methods).
  • Dedicated Computing Power:Each instance is an independent physical device. Under normal operating conditions, core computing resources are not shared with other users.
  • System Environment:Instances come pre-installed with a NodeMini-specified version of macOS. Users may configure the operating system layer, but may not modify the underlying firmware, secure boot settings, or request any physical intervention on the hardware.
  • Network:Each instance is equipped with a dedicated public IP and access bandwidth. Actual available bandwidth is subject to data center egress conditions and internet conditions. NodeMini makes no commitment regarding actual bandwidth levels.
3.2 What the Service Does Not Include
  • Technical support for any third-party applications installed by the user.
  • Any form of automatic data backup or data recovery service (users are solely responsible for backing up all their data).
  • Retention of any data after an instance expires (expired data will be immediately wiped; NodeMini makes no retention commitment).
  • Handling software compatibility issues caused by Apple macOS updates.
  • Troubleshooting connection failures caused by network lines, ISPs, or the user's local environment.
3.3 Right to Adjust Service Specifications

NodeMini reserves the full right to modify, upgrade, downgrade, replace, or adjust service specifications at any time in any manner it deems appropriate, without liability for any compensation.For significant specification changes, NodeMini will endeavor to provide advance notice, but this notification obligation does not constitute any limitation on the right to make adjustments. Continued use of the service constitutes acceptance of the adjusted specifications.

Usage Rules and Prohibited Conduct

You must use NodeMini services in a lawful and good-faith manner and bear full responsibility for ensuring that all your usage complies with all applicable laws and regulations and these Terms.

4.1 Explicitly Prohibited Activities

You may not use NodeMini services for any of the following purposes. Upon discovery, NodeMiniwill immediately and without prior notice suspend or terminate service and forfeit all fees paid. In serious cases, NodeMini will report to relevant law enforcement authorities and cooperate with investigations:

MalwareStoring, distributing, or running viruses, ransomware, spyware, botnet programs, or any other malicious code, regardless of whether actual harm is caused.
SpamSending unsolicited commercial emails, SMS bombing, or conducting mass unauthorized marketing promotions through any channel.
Cryptocurrency MiningRunning any form of cryptocurrency mining program without obtaining prior specific written permission from NodeMini. NodeMini will seek full compensation from the user for hardware accelerated wear and tear caused thereby.
Illegal ContentStoring, processing, or distributing child sexual abuse material (CSAM), copyright-infringing pirated content, terrorism-related content, or any content explicitly prohibited by the laws of the jurisdictions in which NodeMini operates.
Fraudulent ActivitiesOperating phishing websites, fraudulent trading platforms, or any activity intended to deceive third parties.
Platform AttacksAttempting to attack the NodeMini Platform itself, circumvent the billing system, bypass access controls, or interfere with the normal use of other users.
Unauthorized ResaleSelling, transferring, subcontracting, or sharing instance access rights in any form to any third party without explicit written permission from NodeMini.
4.2 Compliance Obligations
  • You must ensure that all software running on the instance holds valid and legitimate license authorization. NodeMini bears no joint liability for user software compliance. All resulting legal consequences and losses are borne independently by the user.
  • When processing personal data on an instance, you must independently bear all legal responsibilities as a data controller, ensuring compliance with all applicable data protection regulations (including but not limited to GDPR and PIPL). NodeMini bears no joint liability in this regard.
  • You must comply with all applicable export control regulations and may not use the service for any sanctioned countries, regions, organizations, or individuals. If NodeMini incurs penalties due to violations of export control regulations by the user, the user must fully compensate NodeMini for all resulting losses.

Monitoring Rights:NodeMini reserves the right to monitor and analyze instance resource usage and network traffic patterns when it deems necessary, in order to identify potential violations, safeguard platform security, and protect the normal use of other users. NodeMini bears no notification obligation with respect to such monitoring activities.

Payment, Billing, and Refund Policy

5.1 Billing Model and Pricing

NodeMini services are charged as full prepayment according to the selected rental plan (daily, weekly, monthly, or quarterly), at the price displayed on the page at the time of order confirmation.NodeMini reserves the full right to unilaterally adjust the pricing of all services at any time. Price adjustments take effect immediately for new orders.NodeMini bears no liability for any losses you incur as a result of pricing adjustments.

5.2 Payment Obligations
  • All fees must be paid in full at the time of ordering. NodeMini does not offer any form of credit or deferred payment arrangement.
  • All fees are inclusive of applicable taxes. Users are solely responsible for all taxes applicable in their respective jurisdictions. NodeMini reserves the right to adjust applicable tax rates as required by tax law.
  • If a dispute is initiated through your payment instrument (credit card chargeback), NodeMini reserves the right to immediately suspend all services and freeze the account. All additional handling fees, processing costs, and losses arising therefrom shall be borne in full by the user.
  • Failed renewal payments will result in immediate service suspension after a 24-hour grace period. During the suspension period, data remains at risk of permanent deletion after 7 days of non-payment.
5.3 Refund Policy

No Refunds as a General Rule:All service fees charged by NodeMini are non-refundable once an instance has been activated. At the moment of instance activation, the corresponding physical hardware is exclusively occupied, incurring real, non-recoverable costs. Please carefully assess your actual needs before placing an order. NodeMini bears no responsibility for any losses arising from inadequate assessment.

ScenarioRefund Handling
Activation failure due to system failureUpon verification by NodeMini, a full refund may be requested only when an instance fails to activate within 60 minutes due to a NodeMini system issue. Refunds are processed via the original payment channel and take 3–7 business days.
User cancellation before activationCancellation requested before instance activation: the remaining amount is refunded after deducting a processing fee (5% of the order amount, minimum $1 USD).
All circumstances after instance activationNo refund.Including but not limited to: voluntary cancellation by the user, no longer needing the service, network connectivity issues, software incompatibility, impact from macOS system updates, and changes in business requirements.
Account terminated due to user violationIf an account is terminated due to the user's violation of these Terms, all fees paid are forfeited and non-refundable. NodeMini also reserves the right to pursue compensation for losses arising from the violation.
NodeMini proactively discontinues serviceWhen NodeMini discontinues service to a specific region or user group due to a business decision, it will endeavor to provide account credit compensation for the remaining rental period (not a cash refund). Specifics are handled on a case-by-case basis, and NodeMini provides no guarantee.
5.4 Overdue Fees

When an account has outstanding unpaid fees, NodeMini reserves the right to: (a) immediately suspend access to all instances under the account; (b) reject all new orders; (c) after more than7 calendar daysof non-payment, terminate the relevant instances without further notice andpermanently and irreversibly wipe all instance data; (d) refer the outstanding amount to a collections agency or initiate legal recovery proceedings. All resulting collection fees, attorney fees, and litigation costs shall be borne in full by the user.

Service Level and Availability

NodeMini will make commercially reasonable efforts to maintain high service availability, butmakes no explicit guarantee or commitment regarding any specific service availability rate, response time, or continuous uptime. None of the following statements constitute legally binding SLA commitments.

6.1 Availability Target (Non-Binding)

The internal operational target of NodeMini is to provide 99% or greater monthly availability for each normally operating instance. This target does not constitute any legal commitment to users, and any failure to achieve this target does not entitle users to any right of claim.

NodeMini will introduce a formal SLA compensation mechanism as the business develops. All users will be notified via platform announcements at that time, and it will take effect in the form of a supplemental agreement. Prior to the release of the formal SLA, this section constitutes the entirety of NodeMini's obligations with respect to service availability.

6.2 Circumstances Not Counted as Service Interruptions
  • Instance unavailability caused by the user's own actions (including but not limited to accidentally deleting system files, misconfiguring firewall rules, etc.).
  • Scheduled maintenance windows (NodeMini will endeavor to provide advance notice, but maintenance may be performed at any time based on operational needs).
  • Force majeure events, including natural disasters, war, large-scale cyberattacks, power outages, government prohibitions, etc.
  • Service suspension proactively initiated by NodeMini due to user violations.
  • Issues with third-party ISPs, internet backbone networks, or the user's local network.
  • Impact caused by Apple macOS updates or unavailability of Apple services (such as Apple ID, iCloud).
  • Any emergency maintenance or security response operations that NodeMini deems necessary.
6.3 Feedback Channel

If you experience a service interruption that appears to be caused by a NodeMini infrastructure issue, please submit feedback through the ticketing system within14 calendar daysof the interruption occurring (attaching the instance ID and the period of interruption). NodeMini will investigate within a reasonable time after receiving the feedback, and the investigation findings shall be NodeMini's final determination.

Intellectual Property

7.1 Absolute Protection of NodeMini Intellectual Property

All intellectual property rights in the NodeMini Platform, management console, API, brand identifiers (the NodeMini name, trademarks, logos, and any derivative identifiers), website design, technical documentation, pricing structure, algorithms, and all content independently developed by NodeMini are exclusively owned by NodeMini Global or its licensors.

These Terms only grant you alimited, non-exclusive, non-transferable, non-sublicensable, revocable-at-any-time right of useto access and use the corresponding instance during the rental period. This does not constitute a transfer, pledge, license, or any other disposition of any NodeMini intellectual property. You may not in any way copy, modify, decompile, disassemble, or reverse-engineer the NodeMini Platform software, management systems, or any NodeMini proprietary technology.

7.2 User Content

The original intellectual property rights in User Content such as code, data, and applications you create and store on the instance belong to you or your licensors. You grant NodeMini a limited license necessary for the provision of services, including the right to process, transmit, and store your content. NodeMini also has the right to anonymize and use service operational data (excluding personally identifiable information) for system optimization and business analysis.

7.3 Royalty-Free Use of Feedback

Any suggestions, feedback, or improvement ideas you provide to NodeMini may be used by NodeMinifree of charge, indefinitely, irrevocably, and without attribution for any commercial purposewithout paying you any remuneration. You may not in any way assert rights against NodeMini for commercial activities undertaken based on your feedback.

User Data and Content

8.1 User Bears Full Responsibility for Data

You bear full, independent, and non-transferable legal responsibility for all data stored, processed, and transmitted on the instance. As a pure infrastructure provider, NodeMinidoes not review the content, legality, accuracy, or completeness of user dataand does not bear any data controller responsibility in connection with the processing of user data. NodeMini is not your data custodian and makes no commitments regarding data security beyond those explicitly stated in these Terms.

8.2 Data Backup: The User's Sole Responsibility

Data backup is solely the user's responsibility. NodeMini does not provide any form of automatic data backup, snapshots, or data recovery services.NodeMini bears no liability for data loss caused by any reason, including but not limited to:

  • Failure to renew after the rental period expires: NodeMini will immediately and irreversibly wipe all instance data after the grace period (24 hours) ends.
  • Intentional or accidental deletion of data by the user.
  • Data corruption caused by hardware failure, natural disasters, or force majeure events.
  • Data encryption, leakage, or loss caused by security incidents (such as ransomware infection or unauthorized access).
  • Data deletion after NodeMini terminates service due to user violations.
  • Data changes caused by any system operations that NodeMini considers reasonably necessary.

Important Notice:Please ensure that all important data on the instance is regularly synchronized and backed up to independent external storage under your control (such as S3, Backblaze B2, or local storage). NodeMini provides no compensation or remedy of any kind for data loss where the user has not backed up their own data.

8.3 Data Deletion and Erasure

After an instance is terminated (for any reason), NodeMini will perform a secure wipe of all storage content of that instance within24 hours. After the wipe, the data ispermanently unrecoverable. NodeMini bears no obligation to return, recover, or retain any wiped data. Users must complete all necessary data migration and backup before service termination. NodeMini bears no responsibility for users who fail to back up their data in time.

Service Changes, Suspension, and Termination

9.1 NodeMini Broad Rights of Suspension

NodeMini reserves the right toimmediately and without prior noticesuspend your account and all instance access rights in the following circumstances, with no refund of fees paid during the suspension period:

  • The account has any outstanding unpaid fees, regardless of the amount.
  • NodeMini has reasonable grounds to suspect that your instance is being used for any activity prohibited under Section 4 of these Terms.
  • Your instance activity is causing or may cause any harm to NodeMini infrastructure, other users, third parties, or public networks.
  • Cooperating with investigations conducted by law enforcement agencies in accordance with the law, or in response to lawful requests from any government agency or regulatory body.
  • Any other reasonable judgment by NodeMini for the purpose of maintaining platform security and stability.
9.2 NodeMini Right to Unilateral Termination

NodeMini reserves the absolute right to unilaterally terminate your account and all services at any time for any reason without providing an explanation.In particular, in the following circumstances, NodeMini will immediately terminate and all fees paid will be forfeited:

  • You violate any provision of these Terms, regardless of severity or whether it is a first offense.
  • You provide false registration information or impersonate another person.
  • NodeMini decides to discontinue service to your region, a specific user group, or any user.
  • Service termination is required by law, government order, or court order.
  • NodeMini requires it for business decision-making or risk control purposes.
9.3 Continuing Effect After Termination

Termination of an account or service does not affect any provision of these Terms that by its nature should continue in effect, including but not limited to: Section 7 (Intellectual Property), Section 8 (Data Deletion), Section 10 (Disclaimer of Warranties), Section 11 (Limitation of Liability), Section 12 (Indemnification), and Section 13 (Dispute Resolution).

Disclaimer of Warranties

Important Legal Notice:This section contains significant limitations and exclusions of NodeMini's liability. Please read it carefully. To the maximum extent permitted by applicable law, all provisions of this section have full legal effect.

10.1 Service Provided "As Is"

NodeMini services are provided on an "as is" (AS IS) and "as available" (AS AVAILABLE) basis,without any express or implied warranties, representations, or commitments, including but not limited to: warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted service, error-free operation, complete security, or freedom from vulnerabilities. NodeMini expressly disclaims all such warranties.

NodeMini expressly does not warrant that: (a) the service will meet any of your specific business needs; (b) the service will be continuously available or free from any interruption; (c) macOS system updates will not affect your installed software, workflows, or business operations; (d) the NodeMini service is compatible with any specific third-party system or software; or (e) the service is free from any security vulnerabilities.

10.2 Third-Party Software and Apple Inc.

The macOS operating system pre-installed on instances is independently developed and maintained by Apple Inc. NodeMini bears no responsibility for any decisions made by Apple Inc. (including macOS updates, feature changes, security patches, or policy adjustments) and makes no warranty regarding the compatibility of macOS with any third-party software. Users independently bear sole responsibility for the license compliance, operational stability, security, and macOS compatibility of all third-party software they install on their instances.

10.3 Network and Connectivity

NodeMini bears no responsibility and provides no compensation for connectivity issues caused by the user's local network environment, intermediate carrier line quality, cross-border network conditions, internet infrastructure failures, or any factor outside the reasonable control of NodeMini.

10.4 Business Decision Risk

NodeMini expressly disclaims all liability for any losses resulting from any business decisions made by the user based on the outputs, operational state, or availability of this service.Users must independently assess the suitability and risks of integrating NodeMini services into their business processes.

Limitation of Liability

11.1 Comprehensive Exclusion of Indirect Losses

To the maximum extent permitted by applicable law,NodeMini, its affiliates, shareholders, directors, officers, employees, and agents shall not be liable for any of the following losses, whether or not they were foreseeable or NodeMini was advised of their possibility:

  • Indirect, incidental, special, punitive, or consequential losses.
  • Any loss of profits, revenue, business opportunities, data, goodwill, or business interruption.
  • The cost of procuring any substitute goods or services due to inability to access or use the service, or due to service delays or failures.
  • Losses suffered as a result of relying on the service to make any business decision.
  • Losses arising from claims or actions brought against you by any third party.
11.2 Full Exclusion of Liability and Residual Cap

To the maximum extentpermitted by mandatory laws in each jurisdiction, all liability of NodeMini arising from these Terms or in connection with the service is fully excluded, with zero indemnification obligation.NodeMini expressly declines to acknowledge any indemnification obligation beyond the scope of this section and will not offer any form of settlement or payment in connection with any such claim.

Only where mandatory provisions of applicable law render the above full exclusion unenforceable in specific circumstances, the total cumulative liability of NodeMini within the minimum scope required by such mandatory provisionsshall be capped solely at the service fees actually paid by you to NodeMini during the calendar month immediately preceding the claim event, and shall not include any interest, indirect losses, fees, or additional damages. NodeMini reserves the right to assert all available defenses against any excess claim.

Statement of Commercial Basis:The liability exclusions in this section are the fundamental premise upon which NodeMini is able to provide services to users at current prices. Neither party may object to this arrangement. The pricing structure of NodeMini is entirely dependent on the above liability arrangement. NodeMini has no obligation to provide services under any terms to any party that does not accept all provisions of this section.

User Indemnification

You agree to fully and promptly indemnify, defend, and hold harmless NodeMini and its affiliates, shareholders, directors, officers, employees, and agents from and againstany and allclaims, actions, losses, damages, judgments, fines, administrative penalties, costs, and expenses (including but not limited to reasonable attorney fees and litigation costs) arising out of or related to:full and timely indemnification, defense, and hold harmless:

  • Your use of or access to the service (including any access by a third party through your account, whether or not authorized by you).
  • Any act or omission by you that violates these Terms, the Privacy Policy, the Acceptable Use Policy, or any other NodeMini policy.
  • Content, code, or applications you run on the instance that infringe upon the intellectual property rights, privacy rights, reputation rights, or any other legitimate rights and interests of any third party.
  • You providing false information, engaging in fraudulent conduct, or impersonating another person.
  • Your violation of any applicable laws and regulations, including but not limited to data protection laws, export control laws, anti-money laundering laws, and cybersecurity laws.
  • NodeMini being subject to investigation, penalties, or reputational damage from any regulatory authority as a result of your conduct or the misuse of your instance.
  • Any liability you incur toward any third party in connection with your use of this service.

NodeMini reserves the right to select its own defense counsel in any litigation or arbitration. Such self-representation does not affect your full indemnification obligation.

Dispute Resolution and Governing Law

13.1 Governing Law

The formation, validity, interpretation, and enforcement of these Terms shall be governed bythe laws of Singapore, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13.2 Informal Consultation (Mandatory Pre-Requisite)

Before initiating any formal legal proceedings, youmustfirst send a written dispute notice to [email protected]detailing the nature of the dispute, the amount at issue, and the resolution you seek. Both parties must engage in good-faith negotiations within60 calendar daysof receipt of the notice. If formal legal proceedings are initiated without completing this pre-requisite, NodeMini reserves the right to apply for dismissal or stay of such proceedings, and all resulting costs shall be borne by the initiating party.

13.3 Binding Arbitration

Disputes not resolved through the pre-requisite consultation shall be irrevocably submitted by both parties to theSingapore International Arbitration Centre (SIAC)for final resolution by arbitration under the SIAC Rules then in force, by a sole arbitrator. Seat of arbitration: Singapore; language of arbitration: English. The arbitral award shall be final and binding on both parties and may be enforced in any court of competent jurisdiction.Arbitration costs shall be advanced by the claimant and ultimately borne by the losing party.

13.4 Waiver of Class Action Rights

You expressly and irrevocably waive any right to assert any claim in the form of a class action, class arbitration, or representative action.You may only bring arbitration on an individual basis for your own dispute and may not consolidate the disputes of other users. Any attempt to bring a claim in a class form shall be void.

13.5 NodeMini Right to Emergency Relief

The foregoing arbitration clause does not limit the right of NodeMini to apply to any court of competent jurisdiction fortemporary injunctions, asset preservation, evidence preservation, or other equitable relief in any circumstances it deems necessary. Such applications do not constitute a waiver of the arbitration agreement.

13.6 Statute of Limitations on Claims

You must bring any claim within 12 months of the occurrence of the event giving rise to the claim. Any claim brought after this period is permanently barred, regardless of the limitation period provided by applicable law.

General Terms

14.1 Unilateral Right to Amend Terms

NodeMini reserves the full right to unilaterally amend any provision of these Terms at any time. Amended Terms take effect against you immediately upon publication on the Platform, without requiring your consent or separate notice.Your continued use of the service after Terms are published constitutes unconditional acceptance of all revised Terms. NodeMini bears no responsibility for any losses you incur as a result of failing to read revised Terms.

14.2 Entire Agreement

These Terms (together with all current policy documents published by NodeMini) constitute theentire agreementbetween you and NodeMini regarding your use of the service, superseding all prior oral or written agreements between the parties on the same subject matter. No oral statements by NodeMini sales personnel constitute an amendment or supplement to these Terms.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions shall continue in full force and effect without any impact.

14.4 No Waiver

The failure of NodeMini to assert or enforce any provision of these Terms does not constitute a waiver of that right. Any waiver of rights by NodeMini must be made expressly in writing to be effective; oral waivers are of no effect.

14.5 Assignment

You may not assign any rights or obligations under these Terms to any third party without the prior written consent of NodeMini. Any unauthorized assignment is void.NodeMini may freely assign all or part of the rights and obligations under these Terms to an affiliate, acquirer, or asset transferee without notifying you. After such assignment, the new entity assumes all of NodeMini's rights under these Terms.

14.6 Force Majeure

NodeMini shall not be in breach of these Terms and shall not be required to provide any compensation or refund to users for any delay in or failure to perform any obligation under these Terms caused by events beyond the reasonable control of NodeMini, including but not limited to natural disasters, war, large-scale cyberattacks, government prohibitions, supply chain disruptions, power supply interruptions, or changes in Apple Inc. policy.

14.7 Language Control

These Terms are governed by theEnglish version as the sole official version. Chinese and other language translations are for reference only and have no legal effect. In the event of any ambiguity or conflict between language versions, the meaning of the English version shall prevail. NodeMini makes no warranty as to the accuracy of the Chinese translation.

14.8 Notices

Notices from NodeMini to you may be sent by email to your registered email address or published as an announcement on the Platform. Such notices are deemed received by you at the time of sending or publication. Notices from you to NodeMini must be sent to [email protected]and shall take effect only upon written confirmation of receipt by NodeMini. Notices without such confirmation have no legal effect.
